Old-age clause
As a buyer of older homes, you should take into account that the requirements that may be set for the quality of the construction may be considerably lower than for new(er) homes. An age clause will be included in the purchase agreement, stating that the buyer declares to be aware that the property is not new, that the buyer accepts all risks with regard to the entire state of the construction and that the purchase price is adjusted accordingly.
Asbestos clause
The seller does know that asbestos-containing materials are present in the property, namely: sheeting outside and also behind the radiator. Given the construction period, it is possible that several asbestos-containing materials are present, as far as known to the occupants there are no other asbestos-containing materials present. Any removal of asbestos-containing materials requires special measures, which are described in the Environmental Act. An asbestos clause will be included in the purchase agreement, stating that the buyer declares that he is familiar with this and thereby indemnifies the seller against any liability if asbestos is found.
Non-residential clause
The Purchaser is aware that the Seller has never actually used the sold property himself and that the Seller therefore cannot inform the Purchaser about properties or defects to the sold property of which the Seller could have been aware if he had actually used the property himself. The Buyer indemnifies the Seller against any third party claims.
